Delivery times for physical CDs
We endeavour to send out physical CDs within 24 hours of receipt of an order, but our guarantee is to send CDs within seven working days of the order having been successfully received and fully paid. UK orders are sent by first class post: those for mainland Europe and the Rest of World are sent by airmail. We will contact you promptly if there is likely to be a delay in our shipping a product to you. We cannot be held responsible for delays caused by the postal service in any country. Goods sent by standard mail cannot be tracked. If you require your order to be tracked, please contact us: there will be an additional fee payable for tracked mail service.
Cancelling an order of physical product
Customers are entitled to cancel the purchase of any physical item within 14 days of delivery. Please return the items within 14 days of their delivery to you: they must be securely packaged. Please ensure that all items remain unopened, are sealed, and are in good condition. Please also enclose the delivery note that was enclosed with your order, and include your name, postal address and email. We recommend that you use recorded delivery. Vivat will reimburse the purchase price paid for cancelled orders or returns within 10 working days of receipt of returned goods when accompanied by the delivery note and reasons for return. For physical goods which have been ordered by you and over which you change your mind within the 14 day period stated above we will refund only the original purchase cost and not any postage or other costs.
Defective goods
If a CD is defective in any respect we will accept return of an opened item provided it is accompanied by a note detailing in what respect you believe it to be deficient. We recommend that you first try a faulty CD in a different player before returning it. Please let us know at what point (track number, time on that track, etc) the fault occurs. If a CD is defective, you do not need to return the case or booklet, just the CD. If the booklet is defective, please do not return it: instead please email us using the contact form on this site and describe the problem. We will post you a new booklet: please remember to include your postal address. Vivat will additionally refund the cost of postage by standard mail if a CD purchased from, and returned to, Vivat is returned due to any error on our part or if the product is agreed by Vivat to be defective.
Return address
Please ensure as above that you outline in writing the reason for the return, and enclose the delivery note that was enclosed with the goods. Carefully and securely wrap the CD and send to:

Downloads
It is your responsibility to ensure that you select download content which is in the format appropriate to your needs and equipment, having first checked the format’s suitability and functionality for your equipment. Once content has been made available for download and the process of downloading that content has begun Vivat is unable to accept a cancellation or effect a refund in relation to orders made in error, or in a format incompatible with your equipment. Orders for downloaded content cannot be refunded unless there is a provable fault in that downloaded content. If a download properly paid for provably fails, Vivat will do its utmost to resolve the issue by providing a functioning download but the liability of Vivat is limited solely to the cost paid for that specific download content. Vivat is not responsible for any loss or damage howsoever arising from use of this website or its content. Content downloaded from Vivat does not convey ownership or any property right or interest: permission to download and use the content extends to the user only and is for the user’s non-commercial use only.
Intellectual property
The content and other material hosted on Vivat’s website (sound recordings, words, pictures, photographs, artwork, logos and other materials) is owned by, or licensed to, Vivat and is protected by copyright and other laws. Users of this site are not permitted to download, copy, reproduce, alter, re-record, perform, publish, broadcast, share, upload or in any other manner disseminate or otherwise transmit any of the content whether for pecuniary advantage or otherwise except as specifically outlined in Vivat’s terms and conditions. Permission to download and use the content extends to the user only and is for the user’s non-commercial use only. Unauthorised use of Vivat’s copyright material may render the user subject to civil or criminal proceedings for copyright infringement.
Verification of orders
When you order physical or download items from Vivat’s website, payment for these is handled by our third party online secure banking partners, SagePay. Only when your payment details have been verified by SagePay and you have received an email from Vivat acknowledging successful receipt of your order is that order deemed to be received and accepted by Vivat.

The prices displayed on this website are inclusive of delivery costs as stated and, where applicable, VAT.
General
By using the website or by making a purchase on the website the user agrees to be bound by Vivat’s terms and conditions which may be amended by Vivat from time to time. It is the user’s responsibility to check the terms and conditions, including any changes which may have been effected since the user’s previous visit to the site. Any dispute arising out of the use of this website or of the services provided via the website shall be adjudged in accordance with English Law for which the High Court of Justice in England shall be the sole court of jurisdiction.
